Terms & Conditions
These Terms and Conditions govern the agreement between Knockin' Gnocchi ("we", "us", or "our") and the client ("you" or "the Client") for the provision of catering services. By confirming a booking and paying the required deposit, the Client agrees to be bound by the following terms.
1. Acceptance of Terms
By paying the deposit and confirming the booking, the Client confirms that they have read, understood, and accepted these Terms and Conditions in full. These terms represent a legally binding agreement between the Client and Knockin' Gnocchi.
2. Booking and Deposit
To secure a booking with Knockin' Gnocchi, a deposit equal to 25% of the total estimated cost is required. This deposit is non-refundable and confirms the Client’s acceptance of these Terms and Conditions. Bookings are not considered confirmed until the deposit is received and written confirmation has been provided by us.
3. Final Payment
The remaining balance (75%) is payable no later than fourteen (14) days prior to the event. If full payment is not received by this deadline, Knockin' Gnocchi reserves the right to cancel the booking and retain the deposit. Services will not be provided without full payment.
4. Final Event Details
The Client must provide final event details—including guest numbers, menu selection, and any dietary or allergy requirements—no later than fourteen (14) days before the event. We reserve the right to refuse last-minute changes and may charge additional fees for adjustments after this deadline. Final charges will be based on the confirmed guest count as of this date, regardless of actual attendance.
5. Dietary Requirements and Allergies
The Client must inform Knockin' Gnocchi of any known dietary requirements and allergies no later than fourteen (14) days before the event. While we take reasonable care to accommodate such requests, we cannot guarantee the complete absence of allergens in any of our food. The Client is responsible for communicating this to guests and indemnifies Knockin' Gnocchi from any claims arising from undisclosed allergies.
6. Tableware and Service Scope
When Knockin' Gnocchi supplies tableware (plates, cutlery, recyclable napkins), our service includes table setting prior to the event, clearing afterward, as well as washing, polishing, and transport of all items.
If the Client chooses to supply their own tableware or hires it from a third party, our service is limited to clearing and scraping items and stacking them for collection. In such cases, we do not provide table setting, washing, or polishing services.
7. Venue Requirements
The Client is responsible for ensuring the venue provides access to running water, a functional cooktop, and a working oven. If any of these are unavailable, the Client must inform Knockin' Gnocchi at least seventy-two (72) hours in advance so alternate arrangements can be made. Failure to do so may result in reduced service or cancellation of certain elements without refund.
8. Venue Access and Equipment Responsibility
The Client must ensure Knockin' Gnocchi has timely access to the venue for both setup and pack down, according to the agreed schedule. The Client will be liable for any damage to our equipment or materials caused by the Client, venue staff, or guests during the event.
9. Cancellations
Cancellations must be submitted in writing. The 25% deposit is non-refundable.
Cancellations within 14 days of the event incur a charge of 50% of the total agreed fee.
Cancellations within 72 hours of the event will be charged in full.
These fees reflect the costs associated with committed time, staffing, and ingredients.
10. Force Majeure
Knockin' Gnocchi will not be held liable for failure to perform obligations due to circumstances beyond our control. These may include, but are not limited to, extreme weather events, natural disasters, power outages, public health crises, or venue-related disruptions. In such cases, affected services may be rescheduled or refunded at our discretion.
11. Photographs and Marketing
We may take photographs of food displays, table settings, or general event setups for marketing purposes. If the Client prefers not to have any aspect of their event photographed, a written request must be submitted prior to the event. Client names and event details will never be published without explicit consent.
12. Liability and Insurance
Knockin' Gnocchi is covered by public liability insurance as required by Australian law. We are not responsible for any injury, loss, or damage that occurs before, during, or after the event, except as required under Australian Consumer Law. Our total liability shall not exceed the amount paid for the services provided.
13. Governing Law
These Terms and Conditions are governed by the laws of the State of New South Wales, Australia. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts of New South Wales.
